Car Accident Liability

I have literally had three family members ask me this question in the last few weeks, so I think it might be useful for some of you too. Let's say that the vehicle in front of you slams on his brakes. You nail him from behind (aka rear ended). Who is at fault?

If you are in this situation, go ask a personal injury attorney about your exact situation. In general, I can tell you that the vehicle in the rear (that's you in this scenario) is at fault. The law generally states that you should drive at a safe distance from the vehicle in front of you so that you can avoid striking him. It is extremely rare for any court to find the vehicle that was rear ended at fault.
